At tonight’s special-called mostly-closed-session dam lawsuit settlement town board meeting, commissioners voted to accept a settlement totaling $9.4 million. This settlement allows the town to avoid a trial, which would have taken place in the Cumberland County Courthouse in a couple of months. The settlement includes $4.25 million from Crowder Construction, $1 million from McKim & Creed, and $4.15 million from AMEC.
The commissioners also voted to announce a request for proposals for dam repairs as the next step of the process. The settlement money is expected to cover the repair costs for the dam as well as to remove the trees and overgrowth that has grown in the lakebed since the most recent breach in June 2010.
